Terms of Use

Introduction
These Terms of Use ("Terms") govern your access to and use of the Fit Rewards mobile application, website, and any related products and services (collectively, the Service).
The Service is operated by Fit Rewards Limited, a company incorporated in New Zealand ("Fit Rewards", "we", "our", or "us").
Please read these Terms carefully before creating an account or using the Service.
By downloading or using the Fit Rewards app, creating an account, purchasing a subscription, or otherwise accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree with these Terms, you must not use the Service.
If you have received access to Fit Rewards Club through a Sponsored Membership provided by an employer, insurer, gym, sporting organisation, community organisation, event organiser, or another approved partner, these Terms still apply to your use of the Service. Any agreement between Fit Rewards and the sponsoring organisation is separate from these Terms.
1. Definitions
In these Terms:
Fit Rewards means Fit Rewards Limited.
Service means the Fit Rewards mobile application, website, Fit Rewards Club, rewards marketplace, Fit Points, and any other products, features or services we provide from time to time.
User means any individual who accesses or uses the Service, including anyone who creates a Fit Rewards account.
Fit Rewards Club means our optional paid subscription that provides access to additional features and benefits.
Sponsored Membership means access to Fit Rewards Club that is provided to a User by an approved organisation, such as an employer, health insurer, gym, sporting organisation, community organisation, event organiser, or another approved partner.
Fit Points means the in-app rewards points earned through eligible activities, promotions, Challenges, or other activities approved by Fit Rewards. Fit Points are not money, legal tender, stored value, or electronic money, have no cash value, cannot be transferred between Users, and cannot be exchanged for cash.
Reward Partner means a third-party business or organisation that offers products, services or experiences through the Fit Rewards marketplace.
2. Who Can Use Fit Rewards
To use Fit Rewards, you must:
- be at least 16 years of age;
- have the legal capacity to enter into this agreement;
- provide accurate and complete information when creating your account; and
- comply with these Terms and all applicable laws.
By creating an account, you confirm that you meet these requirements. You are responsible for ensuring that the information you provide remains accurate and up to date.
If we reasonably believe that you do not meet these eligibility requirements, or that you have provided false or misleading information, we may suspend or terminate your account.
You are responsible for ensuring that your use of Fit Rewards complies with any requirements imposed by your device manufacturer, mobile operating system, Apple App Store or Google Play.
3. Your account
To access most features of the Service, you must create a Fit Rewards account.
When creating and using your account, you agree to:
- provide accurate, current and complete information;
- keep your account details up to date;
- keep your login credentials secure;
- maintain the security of your device where reasonably possible;
- not share your account with another person;
- notify us promptly if you believe your account has been accessed without your permission; and
- use your account only for your own personal use.
You are responsible for all activity that occurs through your account unless it results from our negligence or a security incident outside your control.
We may require you to verify your identity before making changes to your account or responding to certain support requests.
Your account is personal to you and may not be sold, transferred, assigned or otherwise shared without our written approval.
4. Memberships
Fit Rewards currently offers different membership options.
Free Membership
Anyone who meets the eligibility requirements may create a free Fit Rewards account.
Users with a Free Membership can access selected features of the Service, including earning Fit Points through eligible activities and redeeming available rewards.
The features available as part of a Free Membership may change as we continue to develop and improve the Service.
Fit Rewards Club
Fit Rewards Club is our optional premium membership.
Users with a Fit Rewards Club Membership receive access to additional features, which may include:
- Challenges;
- Prize Draws;
- exclusive rewards;
- member-only offers;
- additional promotions; and
- other premium features that we may introduce from time to time.
The features included with Fit Rewards Club are described within the app at the time you subscribe.
Sponsored Memberships
Some Users receive Fit Rewards Club access through a Sponsored Membership.
Sponsored Memberships may be provided by organisations including employers, health insurers, gyms, sporting organisations, community organisations, event organisers, or other approved Fit Rewards partners.
The availability, duration and eligibility of a Sponsored Membership are determined by the agreement between Fit Rewards and the sponsoring organisation. The sponsoring organisation may choose not to renew or continue providing your Sponsored Membership. Fit Rewards is not responsible for that decision.
If your Sponsored Membership ends, your account may revert to a Free Membership unless you purchase your own Fit Rewards Club subscription or another Sponsored Membership is provided.
5. Health & Activity Tracking
Fit Rewards rewards eligible physical activity by using information you choose to share with us through supported health and fitness services or by recording activity directly within the Service.
You can choose to connect compatible health and fitness platforms, including Apple Health, Health Connect, and other supported providers that we make available from time to time. Some third-party integrations are provided through trusted technology partners.
By connecting a third-party health or fitness service, you authorise that service to share the information you have permitted with Fit Rewards. Your use of those services is subject to their own terms of use and privacy policies.
You are responsible for ensuring that any connected services are authorised by you and remain connected if you wish to continue earning Fit Points through those services.
Fit Rewards relies on information received from connected services and activity recorded within the app. We do not guarantee that activity data will always be accurate, complete, synchronised, or available. Delays, interruptions or errors caused by third-party services, device manufacturers or network providers may affect the recording of activity and the awarding of Fit Points.
Where we believe a technical issue has resulted in an incorrect activity record or Fit Points balance, we may investigate and make reasonable adjustments at our discretion.
We may add, remove or change supported integrations and activity tracking methods at any time.
6. Fit Points
Fit Points are the in-app rewards currency used within Fit Rewards.
Users may earn Fit Points through eligible activities, Challenges, promotional offers, referrals, or other activities approved by Fit Rewards.
The number of Fit Points awarded for any activity is determined by Fit Rewards and may change from time to time. Current earning opportunities are displayed within the Service.
Fit Points:
- are not money or legal tender;
- have no cash value;
- cannot be sold, transferred or assigned to another User;
- cannot be exchanged for cash;
- may only be used within the Service in accordance with these Terms.
Fit Rewards may place limits on the number of Fit Points that can be earned within a particular period or through particular activities.
We may correct, adjust, remove or reverse Fit Points where we reasonably believe they have been awarded:
- due to a technical error;
- because of fraudulent or suspicious activity;
- through misuse of the Service;
- in breach of these Terms; or
- for any other reason where an adjustment is reasonably necessary to protect the integrity of the Service.
Where reasonably practicable, we will notify you if a significant adjustment is made to your Fit Points balance.
Unused Fit Points may expire in accordance with any expiry rules published within the Service.
If your account is closed or terminated, any unused Fit Points will be forfeited.
7. Rewards
Fit Rewards allows Users to redeem eligible Fit Points for offers, discounts, products, services or experiences made available through the rewards marketplace.
Rewards are supplied by independent Reward Partners unless expressly stated otherwise.
Each Reward may have its own terms, conditions, eligibility requirements, expiry dates, geographic restrictions or redemption instructions. You are responsible for reviewing those terms before redeeming a Reward.
Reward availability may change at any time. Fit Rewards may add, remove or update Rewards without prior notice.
Once Fit Points have been redeemed for a Reward, the redemption cannot generally be reversed unless required by law or where Fit Rewards determines that a technical error has occurred.
While we carefully select our Reward Partners, Fit Rewards does not control or guarantee the products or services they provide. Reward Partners are responsible for fulfilling their own offers and complying with applicable laws.
If you experience an issue redeeming a Reward, we encourage you to contact the relevant Reward Partner first where appropriate. We may assist in resolving redemption issues where reasonably possible, but we are not responsible for the acts, omissions or failures of Reward Partners.
If a Reward cannot be fulfilled due to an error within the Service, Fit Rewards may, at its discretion, provide a replacement Reward, refund the Fit Points used for the redemption, or offer another appropriate resolution.
8. Challenges
Fit Rewards Club Users may have access to Challenges as part of their subscription or Sponsored Membership.
Challenges are optional activities that allow eligible Users to earn additional Fit Points, rewards or other benefits by completing specified goals within a set period.
Each Challenge may have its own eligibility requirements, rules, objectives, rewards and completion criteria, which will be displayed within the Service.
Fit Rewards may add, modify, suspend or remove Challenges at any time.
If we reasonably believe that a Challenge has been completed through fraudulent activity, manipulation of activity data, misuse of the Service or a breach of these Terms, we may remove any associated rewards, Fit Points or benefits and disqualify the User from that Challenge.
Completion of a Challenge does not guarantee eligibility for any future Challenges, promotions or rewards.
9. Prize Draws
Fit Rewards Club Users may have access to Prize Draws offered through the Service.
Prize Draws may allow eligible Users to use Fit Points to enter for the chance to win prizes supplied by Fit Rewards or a Reward Partner.
Each Prize Draw will include its own rules, including:
- eligibility requirements;
- entry period;
- number of entries;
- prize details;
- winner selection process; and
- any additional terms that apply.
Where required by law, Prize Draws will include details of any alternative method of entry.
Fit Rewards reserves the right to cancel, suspend or amend any Prize Draw where reasonably necessary, including where required for legal, operational or security reasons.
If a User is found to have breached these Terms or attempted to manipulate the outcome of a Prize Draw, we may remove their entries, cancel any prize awarded and suspend or terminate their account.
10. Promotional Codes
Fit Rewards may offer promotional codes from time to time.
Promotional codes may provide benefits including Fit Points, discounts, free access to Fit Rewards Club, or other promotional offers.
Unless otherwise stated, promotional codes:
- may only be used once;
- cannot be transferred or sold;
- cannot be exchanged for cash;
- may expire without notice after their stated expiry date; and
- may be subject to additional eligibility requirements or conditions.
Fit Rewards reserves the right to withdraw, deactivate or refuse any promotional code where we reasonably believe it has been obtained, shared or used in breach of these Terms or any conditions applying to that promotion.
11. Fit Rewards Club
Fit Rewards Club is our optional paid subscription that provides access to additional features and benefits.
Subscription prices, billing frequency and included features are displayed within the Service before you subscribe.
Subscriptions purchased through the Apple App Store or Google Play are processed and managed by Apple or Google respectively.
By purchasing a subscription through either platform, you also agree to the applicable terms and conditions of that platform.
Unless otherwise stated, subscriptions automatically renew at the end of each billing period unless cancelled before renewal through your Apple App Store or Google Play account settings.
Subscription fees are charged by Apple or Google using your selected payment method. Fit Rewards does not collect or store your payment card information.
Refunds for subscriptions purchased through Apple App Store or Google Play are subject to the policies of Apple or Google.
We may change subscription pricing or included features from time to time. Where required by law or by the relevant app store, we will provide reasonable notice before any material changes take effect.
12. Sponsored Memberships
Some Users may receive access to Fit Rewards Club through a Sponsored Membership provided by an approved organisation.
Sponsored Memberships may be provided by employers, health insurers, gyms, sporting organisations, community organisations, event organisers or other approved Fit Rewards partners.
The availability, duration and eligibility of a Sponsored Membership are determined by the agreement between Fit Rewards and the sponsoring organisation.
A sponsoring organisation may choose to begin, change or end a Sponsored Membership at any time in accordance with its agreement with Fit Rewards. Fit Rewards is not responsible for those decisions.
Where a Sponsored Membership ends, your account may continue as a Free Membership unless you choose to purchase your own Fit Rewards Club subscription or another Sponsored Membership is provided.
Where your Sponsored Membership is provided through an organisation, that organisation may receive limited information about your participation in the programme as described in our Privacy Policy.
13. Acceptable Use
We want Fit Rewards to be a fair, safe and enjoyable experience for everyone. By using the Service, you agree to use it honestly and responsibly.
You must not:
- use the Service for any unlawful purpose or in breach of any applicable law;
- create more than one account without our written permission;
- impersonate another person or provide false or misleading information;
- attempt to manipulate, falsify or artificially generate activity data or Fit Points;
- interfere with, disrupt or compromise the security or operation of the Service;
- use bots, scripts, automated software or other technology to access or interact with the Service without our permission;
- attempt to gain unauthorised access to any part of the Service or our systems;
- copy, reproduce, reverse engineer, modify or exploit any part of the Service except where permitted by law;
- use community features, including leaderboards, to harass, intimidate, abuse or impersonate other Users;
- use the Service in a way that infringes the rights of another person or organisation; or
- encourage or assist another person to do any of the above.
Examples of prohibited activity include, but are not limited to:
- attaching a fitness tracker to a moving object or another person;
- using software or hardware to simulate physical activity;
- modifying or falsifying activity data;
- exploiting bugs or unintended features of the Service; or
- attempting to obtain Fit Points, rewards or prizes through dishonest means.
If we reasonably believe that you have breached these Terms or acted in a way that compromises the integrity, security or fairness of the Service, we may investigate the matter and take appropriate action, including:
- removing Fit Points, rewards or other benefits;
- disqualifying you from Challenges or Prize Draws;
- suspending or terminating your account; or
- taking any other action reasonably necessary to protect the Service, our Users or our Reward Partners.
14. Health and safety
Fit Rewards is designed to encourage physical activity. It is not a medical, healthcare, diagnostic or therapeutic service.
Nothing within the Service should be considered medical, health, fitness or nutritional advice, and nothing within the Service is intended to diagnose, treat, cure or prevent any medical condition.
You are responsible for deciding whether any physical activity is appropriate for you.
Before starting a new exercise programme or significantly increasing your activity levels, you should consider seeking advice from an appropriately qualified healthcare professional, particularly if you have an existing medical condition, are pregnant, recovering from injury, or have any other health concerns.
You acknowledge that participating in physical activity involves inherent risks, including the risk of injury, illness or, in rare circumstances, death.
You participate in all physical activities at your own risk.
To the maximum extent permitted by law, Fit Rewards is not responsible for any injury, illness, loss or damage arising from your participation in physical activity or your reliance on information provided through the Service.
Nothing in these Terms limits or excludes any rights or remedies that cannot legally be excluded under applicable consumer protection laws.
15. Third Party Services
Fit Rewards relies on a number of third-party services to provide and operate certain features of the Service.
These services may include:
- Apple Health;
- Health Connect;
- supported fitness device and health platform providers;
- Apple App Store;
- Google Play;
- Reward Partners; and
- other technology providers that support the operation of the Service.
Your use of any third-party service is subject to that provider's own terms of use and privacy policy.
Fit Rewards is not responsible for the operation, availability, security or content of any third-party service.
From time to time, third-party services may experience outages, delays, changes to functionality or other issues that are outside our control. These issues may affect activity tracking, reward availability, subscriptions or other features of the Service.
While we will make reasonable efforts to resolve issues within our control, we cannot guarantee the continued availability or compatibility of any third-party service.
We may add, remove or replace third-party providers at any time where reasonably necessary to operate or improve the Service.
16. Intellectual Property
The Service, including the Fit Rewards name, logo, branding, software, design, content, text, graphics, images, rewards marketplace, and all related intellectual property rights, are owned by or licensed to Fit Rewards unless otherwise stated.
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for your own personal, non-commercial use.
You must not, without our prior written permission:
- copy, reproduce, distribute or commercially exploit any part of the Service;
- modify, adapt, translate or create derivative works from the Service;
- reverse engineer, decompile or attempt to extract the source code of the Service, except where permitted by law;
- remove or alter any copyright, trade mark or other proprietary notices; or
- use the Fit Rewards name, logo or branding in a way that suggests an endorsement or association that does not exist.
If you provide feedback, suggestions or ideas about the Service, you agree that we may use them without restriction or obligation to compensate you.
Nothing in these Terms transfers ownership of any intellectual property rights to you.
17. Suspending or Closing Your Account
Closing your account
You may stop using the Service and close your account at any time.
If you choose to close your account:
- your access to the Service will end;
- any unused Fit Points will be forfeited unless required otherwise by law;
- any active Fit Rewards Club subscription must be cancelled separately through Apple App Store or Google Play, where applicable; and
- your personal information will be managed in accordance with our Privacy Policy.
Suspending or terminating your account
We may suspend or terminate your account, with or without notice where reasonably necessary, including if:
- you breach these Terms;
- we reasonably believe your account has been involved in fraudulent, unlawful or suspicious activity;
- we believe your account has been compromised or presents a security risk;
- we are required to do so by law;
- we discontinue the Service or a significant part of the Service; or
- it is otherwise reasonably necessary to protect the Service, our Users or our Reward Partners.
Where appropriate, we will make reasonable efforts to notify you before suspending or terminating your account.
Termination of your account does not affect any rights or obligations that arose before the account was closed.
18. Liability
Nothing in these Terms excludes, restricts or modifies any rights or remedies that cannot be excluded under applicable law, including the Consumer Guarantees Act 1993 (New Zealand), the Fair Trading Act 1986 (New Zealand), the Australian Consumer Law, or any other applicable consumer protection legislation.
To the maximum extent permitted by law:
- Fit Rewards provides the Service on an "as available" basis;
- we do not accept responsibility for losses resulting from events outside our reasonable control;
- we are not responsible for the acts, omissions or services of third parties, including Reward Partners, health and fitness platform providers, app stores or payment providers; and
- we are not liable for any indirect, incidental, consequential, special or exemplary loss or damage, including loss of profits, revenue, goodwill, business opportunity or data.
Our total liability arising out of or relating to the Service is limited to the greater of:
- the total amount you paid directly to Fit Rewards for the Service during the 12 months immediately before the event giving rise to the claim; or
- NZD $100.
This limitation applies whether the claim arises in contract, tort (including negligence), statute or otherwise.
19. Disclaimers
While we aim to provide a reliable and enjoyable experience, we cannot guarantee that the Service will always operate without interruption or error.
To the maximum extent permitted by law:
- the availability of the Service may be affected by maintenance, updates, third-party services, network interruptions or events outside our reasonable control;
- activity tracking, Fit Points, rewards, Challenges and other features may occasionally be delayed, unavailable or affected by technical issues;
- Reward availability may change without notice;
- we do not guarantee that the Service will always be compatible with every device, operating system or third-party service; and
- information provided through the Service is for general information only and should not be relied upon as professional medical, health, fitness, nutritional, financial or legal advice.
Although we make reasonable efforts to keep information within the Service accurate and up to date, we do not warrant that all content will always be complete, accurate or current.
Where a problem occurs that is within our reasonable control, we will endeavour to resolve it as soon as reasonably practicable.
20. Electronic Communications
By creating an account and using the Service, you agree to receive communications from Fit Rewards electronically where permitted by law.
These communications may be provided by email, through the Service, by push notification, or by any other electronic method we make available.
Electronic communications may include:
- account and security notifications;
- subscription and billing information;
- reward redemption confirmations;
- Challenge and Prize Draw updates;
- changes to the Service;
- updates to these Terms or our Privacy Policy; and
- other information relating to your use of the Service.
Some communications are necessary for us to provide the Service and cannot be opted out of while you continue to use Fit Rewards. Marketing communications are separate and can be managed as described in our Privacy Policy.
21. Changes to these Terms
We may update these Terms from time to time to reflect changes to the Service, our business, applicable laws, or for other operational reasons.
Where we make a material change to these Terms, we will provide reasonable notice where practicable, including by email, through the Service, or by another appropriate electronic method.
The most current version of these Terms will always be available through the Service and on our website.
By continuing to access or use the Service after updated Terms take effect, you agree to be bound by the revised Terms.
If you do not agree to any updated Terms, you must stop using the Service and close your account.
22. General
Entire Agreement
These Terms, together with our Privacy Policy and any additional terms or policies made available through the Service, form the entire agreement between you and Fit Rewards regarding your access to and use of the Service.
Severability
If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be severed to the extent necessary, and the remaining provisions will continue in full force and effect.
No Waiver
If we choose not to enforce any provision of these Terms, or delay enforcing it, this does not waive our right to enforce that provision or any other provision at a later time.
Assignment
You may not assign, transfer or otherwise deal with your rights or obligations under these Terms without our prior written consent.
We may assign or transfer our rights and obligations under these Terms where reasonably necessary, including as part of a merger, acquisition, business restructure or sale of our business.
Survival
Any provisions of these Terms that, by their nature, are intended to continue after your account is closed or these Terms end, including those relating to intellectual property, liability, dispute resolution and governing law, will continue to apply.
23. Governing Law
These Terms are governed by the laws of New Zealand.
You agree to submit to the non-exclusive jurisdiction of the courts of New Zealand in relation to any dispute arising out of or relating to these Terms or your use of the Service.
If you are a resident of Australia, nothing in these Terms excludes, restricts or modifies any rights or remedies you may have under Australian Consumer Law or any other applicable Australian legislation.
Before commencing formal legal proceedings, we encourage you to contact us so that we can attempt to resolve the issue in good faith.
